Terms of Service for CanvasToolkit

These Terms of Service ("Terms") govern your access to and use of CanvasToolkit (the "Service"), a product developed and operated by Viper Industries ("Company", "we", "us", or "our"), accessible at canvastoolkit.com. By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian. By using the Service you represent and warrant that you meet these requirements and that all information you provide is accurate and current.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Each subscription is licensed for a single user. Sharing, reselling, or transferring your account or subscription is prohibited. We may enforce a single active device or session per account and may suspend accounts that appear to be shared or abused.
3. The Service
CanvasToolkit provides software tools intended for personal, lawful use. You are solely responsible for how you use the Service and for ensuring that your use complies with all applicable laws, as well as any rules, codes of conduct, or agreements that apply to you, including those of your educational institution. We do not endorse and are not responsible for any use of the Service that violates such rules or laws.
4. Subscriptions, Billing, and Renewal
Certain features of the Service require a paid subscription. Subscriptions are billed in advance on a recurring basis (for example, monthly) at the price and interval presented at checkout.
Your subscription automatically renews for successive periods until you cancel it. Unless and until you cancel, you authorize us and our payment processor to charge your payment method for each renewal at the then-current price. Renewal charges are applied at the start of each new billing period.
You may cancel your subscription at any time from your account page or through the billing portal made available to you. When you cancel, your subscription remains active until the end of the current billing period, after which it will not renew and access to paid features will end. Cancellation does not retroactively refund amounts already paid.
Payments are processed by our third-party payment provider, who acts as the merchant of record for your purchase. Your purchase is also subject to that provider's buyer terms. We may change subscription prices from time to time; any price change will apply to billing periods after we provide notice to you.
5. Refunds
All payments are final and non-refundable, except where a refund is required by applicable law. Please review our Refund Policy, which is incorporated into these Terms by reference.
6. Acceptable Use
You agree that you will not:
- Use the Service in any way that violates applicable law or the rights of others;
- Reverse engineer, decompile, tamper with, or attempt to bypass any security or licensing controls in the Service;
- Resell, redistribute, sublicense, or share access to the Service or your account;
- Use automated means to access the Service other than as expressly permitted;
- Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure.
7. Intellectual Property
The Service, including all software, text, graphics, and other content we provide, is owned by or licensed to Viper Industries and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use in accordance with these Terms. No other rights are granted.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any results obtained through the Service will be accurate or reliable.
9. Limitation of Liability
To the maximum extent permitted by law, in no event will Viper Industries or its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including payment obligations, disclaimers, and limitations of liability) will survive.
11. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Texas, United States, except where prohibited by applicable law.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the new Terms on this page. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
